Handling low performers is a delicate situation that leaves managers facing the necessity to deal with multiple issues: both human - why the low performance and can it be remedied? - and legal - what I am allowed to do about it in Japan from a labor law perspective? Our next HR committee will address those two aspects as seen by a professional coach and a lawyer specialized in employment disputes’ resolution.

Mr. Patrick Laudon is an Executive Coach based in Tokyo. He works with executives employed at Japanese and foreign companies here in Japan. As a coach, performance at work arises as a recurrent theme for his coaching partnerships. Based on his daily experience and latest findings in organizational behavior, Patrick will share insights about what is an environment where performance happens, how it is related to leadership and motivation, and who are the key stakeholders to be involved.

Ms. Akiko Monden is a Japanese law attorney (bengoshi) specializing in advising and representing employers (management) in negotiations and disputes with employees, with extensive experience in representing employers in poor performance cases both in and out of court.
Akiko will provide an overview of the legal principles which apply to managing poor performance in the workplace, and provide examples of the cases she has handled in court with advice on the do’s and don’ts in performance evaluation, measures to take to address performance issues, and how to deal with a possible dismissal.
