What leaders need to know about monitoring employees’ working hours and preventing power harassment in the workplace

The French Chamber’s Tax and Regulations Committee is glad to propose a seminar on what employers should know about monitoring and controlling employees’ working hours and power harassment in the workplace. Japan’s culture of long working hours may not be a new phenomenon (it was first recorded in the 1960s) but recently high-profile cases have put karoshi (death from overwork) back into the spotlight.

The Ministry of Health, Labour and Welfare released Japan’s first white paper (the “White Paper”) on the prevention of Karoshi, pursuant to the Law on Promotion of the Prevention of Death by Overwork, etc., which was enacted in 2014. The White Paper includes, among other things, surveys and actual case studies regarding Karoshi, countermeasures, and it revealed that, from a survey of 10,000 companies, employees in almost 23 percent of companies worked more than 80 hours of overtime a month.

Earlier this year, the Japanese government proposed limiting average overtime to 60 hours a month though firms would be allowed to increase this to 100 hours during "busy periods". It is also important to take due care in preventing power harassment in the work place, which is increasingly becoming a cause of labor disputes in Japan. Power harassment often leads to forced long work hours of the harassed employees and mental disorders in serious cases.

About the speakers

Tomoko Narita, Counsel and attorney-at-law at TMI Associates, has extensive experience in advising both domestic and international clients in an array of industries on labor and employment law matters, and regularly represents clients in litigation and arbitrations. Clients rely on her practical and effective advice, and also on her strong ability to communicate fluently in English which she gained from her experience living and studying in the United States for a total of over 10 years.

Seiji Kurihara, Senior Associate and attorney-at-law at TMI Associates, provides labor and employment advice to multinational companies of a broad range of industries. He has about 12 years of experience as an attorney specialized in labor and employment field and regularly advises employers on the establishment and operation of personnel systems, personnel transfers, change of employment conditions and reductions in force, assists employers in collective bargaining with trade unions, and represents employers in lawsuits and labor tribunal proceedings.
